Some
U.S. states face so much pressure to fund pensions for public
employees that it could hurt their credit ratings, Moody's Investors
Service said on Thursday.

As concerns grow over the
financial health of many states after the 2007-2009 recession and how
they will cut spending to cope, the ratings agency combined pension and
debt data to rank the liabilities of each state.

 

In
the past, Moody's evaluated credit risks from pensions and debt levels
separately. Lower credit ratings could raise the costs to states of
borrowing money.

 

Connecticut, Hawaii, Illinois, Kentucky,
Massachusetts, Mississippi, New Jersey and Rhode Island, along with
Puerto Rico, have the largest debt-and-pension loads, Moody's found.

 

Nebraska and South Dakota have the lowest.

 

"Large
and growing debt and pension burdens have been, and will continue to
be, contributing factors in rating changes," Moody's said.

 

Problems
with pensions -- which states have underfunded by at least $700
billion -- include weak returns on investments, not enough money set
aside, impending retirements of "Baby Boomers" born in the late 1940s
through mid-1960s, and Americans living longer, Moody's said.

 

New
York, Delaware and California are often cited for large debt burdens
but do not have the highest combined long-term liabilities, Moody's
analyst Ted Hampton said in a statement.

 

"In general, states'
rankings for debt and pension combined parallel their rankings for debt
alone," Hampton said but he added: "not all states with large debt
burdens also suffer from weak pension funding."

 

IN THE TRILLIONS?

 

The
$700 billion underfunded figure is a conservative estimate for how
much money states will need to cover the pension promises they have
made to their employees.

 

But $3 trillion could be nearer the
mark, one study warned last year. States expect too generous a return
on investments made by their pension funds, said the study by Joshua
Rauh of the Kellogg School of Management at Northwestern University.

 

Regardless of the exact amount, states have to find a way to adequately fund pensions.

 

"More
and more, it's going to take up a larger share of their ... budgets,"
said Kil Huh, director of research at Pew Center on the States, which
has been closely following the pension issue.

 

Money
flows from three major sources into pension funds: employee
contributions, the employing governments and investment returns.

 

"Employee
contributions have gone down and, at the same time, employer
contributions because of the fiscal crisis haven't been there," Huh
said.

Moody's, too, says the problem is getting bigger.

 

"Unfunded
pension liabilities have grown more rapidly in recent years because of
weaker-than-expected investment results, previous benefit enhancements
and, in some states, failure to pay the full annual required
contribution," the report said.

 

"Moreover, pension liabilities may be understated because of current governmental accounting standards," it added.

 

The
Moody's report "will shed more light upon the states which have
eliminated or underfunded their yearly contributions for pension
liabilities simply as a way to manage their finances," said Thomson
Reuters Senior Market Strategist Daniel Berger.

 

One
dramatic solution to the pension problem would be allowing states to
declare bankruptcy, which some congressional Republicans want. Then,
they could renege on pension promises made to employees.

 

After
being criticized for missing risks in the housing boom, Moody's is
showing with this report it's "not asleep at the wheel" on the pension
threat, said Richard Larkin, senior vice president and director of
credit analysis at Herbert J Sims & Co. in New York.

 

But, the
report also showed the liabilities are manageable, he added. For
example, Moody's found Hawaii's pension-and-debt load is equal to 16.2
percent of its gross domestic product, the biggest proportion of all the
states.

 

Even though the liabilities are in the billions of dollars, "when you compare them to GDP it's still low numbers," Larkin said.

 

"And
it's still relatively much lower than these problem countries people
keep comparing them to," he said, referring to recent fears that
California or Illinois will soon be plunged into troubles similar to
those Greece or Ireland are facing.

Making Money Without


This occurred on a panel at a meeting of the Mortgage Bankers Association, where Platt appeared with Georgetown Law Professor Adam Levitin, who has been critical of MERS. I corresponded with Levitin, and this was an accurate rendering of Platt’s remarks.


“My response was that’s nonsense,” Levitin wrote in an email. “No one, absolutely no one, is arguing that a valid security agreement should not be enforced. Instead, the issue is whether we should enforce invalid security interests or let parties that do not hold a security interest enforce someone else’s. I hardly think that denying parties that right will result in a change in the cost of credit. It might result in them changing law firms, however, to ones that didn’t screw up their securitization deals.”


MERS, an electronic database created and funded by the banks to avoid land recording fees at county offices, has been criticized on multiple fronts. First of all, they don’t track the information inputted in the database, leading to inaccuracies between what appears in MERS and what appears on the note. Second, they stand in as the mortgagee and sell Vice Presidencies in their company when servicers attempt to foreclose, at the same time saying they have no financial interest in the loan. Third, banks using MERS failed to convey mortgages and notes properly, instead using this unregulated private system, and have broken chain of title in many circumstances, voiding their right to foreclose or even collect payments from a borrower.


Platt clearly wants to threaten the political system here. He’s saying that mortgage interest rates will skyrocket and constituents will become angered if the banks aren’t allowed to do what they want. That aims at a political settlement that stops the courts from making findings of the banks’ wrongdoing under the law. “If we want to have a well functioning credit system, we need to enforce security interests when they are done in compliance with the law, and not enforce them when they fail to comply,” Levitin wrote. “This is fundamental commercial law—you screw up on dotting the I’s and crossing the T’s in a security interest and you’re SOL. Everyone knows the rules of the game going in and there’s no reason to bailout sophisticated parties who failed to comply with the law.”


The notion that MERS saves the banks so much money that they can offer loans at multiple percentage points less than what they’d have to without it is extremely puzzling. “I don’t know of anyone who has argued that MERS lowered interest rates,” Levitin wrote. He estimated that the banks saved “maybe $50 per loan” using MERS, which certainly makes it worthwhile from their perspective, given the millions of loans on the system, but which makes the claim of massive savings to interest rates just foolish. “Of course, even if MERS lowers interest rates, we have to ask at what cost, and a screwed up title system is a pretty high cost for saving a few bps (basis points),” Levitin concluded.


Looking at this chart of mortgage rates from before and after MERS came into existence in 1995, you can see no evidentiary basis for the claim that MERS lowered interest rates; the mortgage lending rate basically tracks the prime interest rate.


At the root, this is a scare tactic. The banks don’t want to change their systems, and they certainly don’t want them found illegal. So they trot out corporate lawyers to make baseless charges that will be taken in Washington as conventional wisdom. And the politicians will scramble to make sure the inaccurate consequences never take place.



I started writing TV recaps and reviews a few years ago when a friend of a friend at a major newspaper told me they were expanding their TV coverage and needed people do cover a few shows, so I picked up two programs I already watched a lot, 'The Office' and 'ER.' It sounded easy enough, writing my thoughts on shows I already had opinions on anyway, although it took several tries to get the tone right–sometimes it still does. Some publications want a lot of recap, and some prefer that you assume that the readers saw the show and just touch on the major points. Some editors encourage plenty of sassmouth and snark, whereas others won’t tolerate even a hint at a swear word.


Typically, I'm assigned to review either an episode or a series of a show. I watch the show, and as quickly as possible, but as thoughtfully and with as much "voice" as possible, record my impressions of the quality of the episode along with the recap.


It’s a fun job, one that I’m lucky to have, period, let alone make a few bucks off, but like any writing gig, it comes with its own writey lessons.


Long scripted dramas and reality TV shows are the easiest to cover. Half-hour comedies are some of the hardest. It can be difficult to stretch a recap of a half-hour show into several good paragraphs and you can only say “…and it was funny when…” so many times. Also really hard to turn into something: results shows that aren’t finales.They’re usually all filler except for the results–the best reality TV competition shows are figuring out how to make the results shows worth watching because otherwise people will just skip and read about what happened online. With a drama, though, you can usually find something to say about the season (or series) as a whole even if the episode didn’t give you a ton to work with.


Screeners make life so much easier. I think I automatically relax and like a show more if I know I have a day or two to think about it after I watch it than if I only have an hour or two to write it up. Knocking out a writeup on a two-hour episode of 'American Idol' an hour after seeing it and making it comprehensive, entertaining, and spelling-error free is sometimes a challenge.


Livechatting reality TV show finales is way more fun than writing about them. As great a job it is to write about television, actually talking to like-minded people in real time and trying to one-up each other with jokes and observations is more fun. They’re like TV-watching parties but without that pesky real live interaction that goes along with that whole having-to-put-on-a-bra thing.


If you truly love a show, don't review it. I get asked occasionally to review 'RuPaul's Drag Race' but I won't, at least not full-time, because I like saving that show as pure entertainment, just me and the TV and no notes or observations. Because even though writing about TV isn’t especially grueling work, it’s still work, and if you really love letting a show take you away for a little while, it’s best just to keep it as entertainment without turning it into an assignment, to remember what it’s like to just watch something without taking notes. I do like subbing for people who cover shows I watch just for fun, though. There’s less pressure to come up with something new to say, and you get to come at it from a fan’s perspective, not a critic’s. Plus, if for some reason you rub the readers the wrong way, it was just a one-time thing and they won't be back next week to tell you what an ass you are.


Commenters will eat your soul if you let them. I have other critic friends who can avoid comments completely or not let them get to them. I am not one of these people. Why do I read comments on my pieces? Because I’m a masochist, that’s why. I guess I should stop being surprised when people use the internet's anonymity to be jerks. Being told that your mother should have had aborted you when she had the chance because of your opinion on 'Lost' (this didn’t happen to me, it happened to a colleague) never goes down easy. I learn to laugh a day or two later but I’m still naively shaken sometimes by how rude people can be (My opinion on one episode of 'SNL' made one person decide that I am "literally retarded"). That said, I also feel crappy if a commenter politely points out that I made a mistake or missed something.


Whenever people find out you're a TV critic and ask you what’s good, without fail, you draw a blank and then you feel like an idiot. I feel like I can’t keep saying 'The Wire' for forever, I’m afraid to admit to how loyal a 'Bridezillas' viewer I am. Alternately, they haven't heard of any of the shows you do recommend. Or, they watched a few episodes of your favorite show and hated it and then you say “Oh, well,” and secretly judge them.


Network swag is fun to receive, and then you throw it away. It’s entertaining to receive a big silly package from a network in the mail, until I realize that I have to dispose of all the packaging that it came in and what do I need with some of this swag, anyway? Except the time that a network sent me some pancake mix and syrup for Christmas. That was great.


Going out and having a few drinks before you go home to write sounds like a much better and more enjoyable idea than it is. For something that sounds so fun and easy, you have to take it pretty seriously in order to do a decent job at it, especially since there are probably 200 people who would gladly take over covering for you. This goes double if you have a day job and can’t afford to sleep in because you started watching the two-hour 'Idol' “event” at 10 PM.


Change is good. 'American Idol' is only two episodes in but the consensus amongst reviewers is that, so far, it’s not too terrible. In my experience, a reality TV show changing up its format, if even slightly, is a good thing, at least from a writing perspective. When 'So You Think You Can Dance' incorporated its All-Stars last season, it might not have been for the best of the show, but at least I could evaluate the changes and ask the readers what they thought. When a show rests too long in format you can get too comfortable (Eventually I had a hard time finding much to say about 'Project Runway' for the first 75% of each episode, since it started to feel like everything prior to the runway was pretty irrelevant, unless Tim Gunn did something noteworthy).


Tim Gunn, over the phone, is as nice as you’d hope he’d be. Better, even. Classy, charming, intelligent, friendly: I was so excited after I interviewed him that I did a horrible job spell-checking the interview and let it get posted when it really shouldn’t have.
